AGB - The Modelinstitute/JG Services
Section 1 Scope and Contractual Partners (1) These General Terms and Conditions (hereinafter referred to as "GTC") apply to all contracts for coachings, webinars, seminars, and intensive workshop formats (hereinafter collectively referred to as "Events") concluded between The Modelinstitute (hereinafter referred to as "Organizer") and the customer (hereinafter referred to as "Participant" or "B2B Partner"). (2) The Organizer's services are directed at both consumers (models, participants, represented by their legal guardians where applicable) and entrepreneurs (modeling agencies, companies, brands). (3) In the case of minor participants, the contract is concluded exclusively with their legal representatives (legal guardians) as the contractual partners. By registering a minor, the legal guardians confirm their express consent.
Section 2 Description of Services and Conclusion of Contract (1) The Organizer offers services in the field of model coaching, technical training (including catwalk, posing, on-set behavior, casting preparation) as well as mental strengthening and personal development (mindset, yoga, stress management, nutritional counseling). The precise scope of services is derived from the respective product description on the website or the individual offer. (2) The presentation of the events on the website does not constitute a legally binding offer, but rather an invitation to submit a booking. By submitting the online booking form or confirming via email, the customer submits a binding offer. The contract is only formed upon written confirmation (via email) by the Organizer. (3) Important Industry Notice: The Organizer provides sound specialist and strategic knowledge through experienced industry coaches. Successful participation in an event expressly does not guarantee the conclusion of an agency contract or subsequent paid modeling bookings.
Section 3 Prices and Payment Terms (1) The prices stated on the website at the time of booking or individually agreed prices shall apply. Unless otherwise stated, all prices include the statutory value-added tax (VAT). (2) Unless otherwise agreed (e.g., in the case of explicitly offered installment payments), the participation fee is due immediately upon invoicing and prior to the start of the event without deduction. (3) In the event of default of payment, the Organizer is entitled to exclude the participant from the event. The obligation to pay the fee remains unaffected by this.
Section 4 Cancellation and Withdrawal by the Participant (1) Since places for exclusive masterclasses and the intensive 4-day workshops are strictly limited and fixed fees are incurred for the industry coaches, the following graduated cancellation fees apply to cancellations by the participant: Up to 30 days before the start of the event: free cancellation is possible.
29 to 14 days before the start of the event: 50% of the agreed participation fee.
From 13 days before the start of the event or in the case of non-attendance: 100% of the agreed participation fee. (2) Cancellations must be made in text form (e.g., via email). The participant is entitled to nominate a qualified replacement participant, provided that they meet the requirements for participation. In this case, no additional cancellation fees will be incurred.
Section 5 Cancellations, Changes, or Rescheduling by the Organizer (1) The Organizer reserves the right to cancel or postpone events for important reasons (e.g., sudden illness of core coaches such as Juliane Braun, failure to reach the minimum number of participants, or force majeure). (2) In the event of a complete cancellation, fees already paid will be refunded immediately. Further claims (e.g., travel or hotel costs incurred by the participant) are excluded, unless the cancellation is based on gross negligence or intent on the part of the Organizer. (3) The Organizer is entitled to replace announced coaches with equally qualified industry experts if necessary (e.g., due to short-term booking cancellations of the coaches within the active fashion business). This does not entitle the participant to withdraw from the contract.
Section 6 Copyrights, Rights of Use, and Image Rights (Content Clause) (1) All documents, presentations, and digital content handed out within the scope of the coachings, webinars, and workshops are protected by copyright. Reproduction, disclosure to third parties, or commercial use—even in extracts—is prohibited without the express written permission of the Organizer. (2) Use of Behind-the-Scenes (BTS) Material: Within the framework of the events, the Organizer produces photo, video, and audio material for quality assurance, for the creation of content synergies for B2B partners, as well as for its own promotional use on social media channels (in particular Instagram) and the website. (3) By participating in the workshops, the participants (or their legal guardians) consent to recordings in which they are visible being used free of charge and for an unlimited period of time within the scope of the Organizer's promotional communication. This consent can be revoked at any time in text form with effect for the future, provided that this does not conflict with legitimate interests of the Organizer or contractual obligations towards third parties.
Section 7 Liability and Health Requirements (1) Participation in the events, particularly in physical modules such as catwalk training, fitness coaching, yoga, and movement training, requires normal psychological and physical resilience. Participation is at the participant's own risk. (2) The Organizer shall only be liable for damages resulting from injury to life, body, or health if they are based on an intentional or negligent breach of duty by the Organizer or its vicarious agents. For other damages, the Organizer shall only be liable in cases of gross negligence or intent.
Section 8 Code of Conduct and Exclusion from Participation (1) The Organizer attaches the highest value to professionalism, mutual respect, integrity, and the protection of the mental health of all parties involved. Participants undertake to follow set etiquette as well as the instructions of the coaches. (2) Participants who sustainably disrupt the course of an event, behave in a grossly disrespectful manner towards coaches or other participants, or act to the detriment of the business, may be excluded from further participation after a single warning. In this case, no refund of the participation fee will be issued.
Section 9 Statutory Right of Withdrawal for Consumers Consumers are entitled to a statutory 14-day right of withdrawal when concluding distance contracts. Detailed information on the right of withdrawal as well as the model withdrawal form will be provided to the participant separately during the booking process. (Note: In the case of services that begin within the withdrawal period and are fully rendered—such as digital live webinars—the right of withdrawal expires prematurely as soon as the service has been fully rendered and the consumer has expressly agreed to this).
Section 10 Final Provisions (1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). (2) Should individual provisions of these GTC be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected thereby (Severability Clause).
